Snakes Makes Samuel L Jackson The New Chuck Norris

I love movies, but I barely go to the theaters. In fact the last film that I saw in the theaters was Revenge of the Sith. I don’t go to the films primarily because I’ve got a great home theater set up and because it so damn expensive. I also tend to find that the crowd detracts my attention from the films. Whether it’s ringing cell phones, crying babies or just rude talkers, I’ve found that watching a DVD has more enjoyment then seeing a film.

When I first saw the buzz for Samuel L Jackson’s Snake’s on a Plane, my first reaction was to defenitely wait until this came out to DVD, but after seeing an audience participation script online and learning more about how Jackson’s used the internet to preserve the integrity entertainment of the film. I was convinced that this was one movie that wouldn’t be the same at home as it would in the theaters. When I got to the theater it was about half full and filled with mostly 20 - 30 year olds who had clearly read about the film online as well. During the movie people shouted out lines from the script and there was plently of laughing, cheering and ohh no they didn’t’s throughout the whole film. When it was over most people actually sat through the credits and cheered.

It would be easy to overthink this film and dismiss the simple plot or the sometimes rough acting as a sign of how bad it is, but the truth is that if you go into the film with the lense of a critic then you will be disappointed, but if you go in wanting to see some bad ass mofo snakes on a mofo plane, then prepared to be very satisfied. In the same way that Chuck Norris movies kick ass even though they are so bad, there is a similar appeal to SoaP. It’s in your face, no holds back attitude is what ends up making this film work.

TiVo Wins Injunction Against Dish: Echostar Must Disable DVRs

Over the last several years, TiVo has been in a bitter patent dispute with Echostar over their use of TiVo’s technology. After winning a jury verdict last April, TiVo was awarded $74 million. In addition to these jury damages, TiVo could also receive treble damages of up to tripple that amount from the judge overseeing the case. After winning the verdict award, TiVo immedietely filed for an injunction against Dish asking Judge Folsom to prevent Dish from selling DVRs and to prevent them from continuing to operate the 4 million DVRs that Dish has sold to date. In early August, the judge met with TiVo and with Echostar and told them that he was granting TiVo’s request for an immediete injunction, but he also placed both companies under a gag order until two more additonal issues were worked out. While TiVo and Echostar both have remained silent on this issue, someone may have forgotten to tell the Eastern Texas weblog about the order because they are reporting that Judge Folsom granted the immediete injunction against Dish.

Update #2 -
After TiVo first won their jury verdict, Echostar and TiVo both issued dueling press releases regarding the status of their injunction. At the time, Echostar pointed to the recent Supreme Court decision between Ebay vs. Merc as an example of why they expected to have their injunction stayed. Ironically, in his decision, Judge Folsom specifically cites that case and expands on his rationale for granting the injunction.

“Plaintiff has demonstrated both that it continues to suffer irreparable harm in the absence of an injunction and that there is no adequate remedy at law. Defendants compete directly with Plaintiff – Defendants market their infringing products to potential DVR customers as an alternative to purchasing Plaintiff’s DVRs. The availability of the infringing products leads to loss of market share for Plaintiff’s products. Loss of market share in this nascent market is a key consideration in finding that Plaintiff suffers irreparable harm – Plaintiff is losing market share at a critical time in the market’s development, market share that it will not have the same opportunity to capture once the market matures.”

This is a tremendous victory for TiVo in that it not only forces Dish to make a tough decision to settle their case or to lose market share, but it also sends a clear message to the other cable companies that if they can’t work out a deal with TiVo, then TiVo has real teeth to hurt them with. Dish may continue to appeal their loss and in fact, on their most recent earnings call they did indicate that they were working on a backup solution that wouldn’t infringe on TiVo’s patents, but this is now a very dangerous game of chicken for them to play. DVRs may have been slow to catch on, but their growth has undeniably increased and it’s the type of functionality that once you have, you can’t ever go back. When I first used TiVo, it was a life changing moment. I was no longer tethered to the Network’s schedules, TV was now tethered to my schedule. At the time I didn’t think I needed it, but after trying it, I realized how important time shifting could really be. If Dish insists on moving forward with their appeal, they will undoubtably lose customers to DirecTV and to the cable companies. Given the high cost to replace their 4 million boxes, as well as the churn that they would experience from not being able to offer this service, I would be very surprised if Dish doesn’t finally break down and make a settlement with TiVo. Dish still has their legal rights to move forward with their appeal, but given the patent review, the jury decision and now the injunction, it’s hard to see how they could convince a judge to overturn this ruling.

Update - Dave Zatz has a scan of the actual order by the judge and it indicates that TiVo did not receive treble damages, but will be receiving approximately $15 million more in damages and interest owed on their $74 million verdict. The judge’s order instructs Dish to cease operation of their boxes within 30 days.

Update #2
- Echostar is out with the first statement on the injunction. In a press release the company says that they are pleased that the courts concluded that they did not willfully infringe and that they plan on appealing the injunction. It looks like the company isn’t done fighting yet.

“We are pleased the Court concluded EchoStar did not act in bad faith and did not copy Tivo’s technology, and we intend to continue our vigorous defense of this case. We believe that, for a number of reasons, the Texas Court should be reversed in all other respects on appeal. We also continue to work on modifications to our new DVRs, and to our DVRs in the field, intended to avoid future infringement. Existing DISH Network customers with DVRs are not immediately impacted by these recent developments, and we will keep consumers informed as events develop. We hope to have additional information for our customers very soon.”

Nintendo Says No To Online Gaming Fees

Well as some of you might know, I’m not exactly a fan of the whole subscription game business model. I think that it prevents casual gamers from enjoying games at a leisurely pace and instead forces gamers into addictive massive hypnotic inducing sessions in order to maximize on their arcade credits. This is why I was pleasantly surprised to see Nintendo announce that they aren’t going to be charging online access fees to their subscribers. From Ars Technica’s coverage of it, I’m unclear as to whether or not their partners will charge for access, but at the very least their in house games will be free and Wifi enabled.

The online model for the Wii will be similar to the model for the Nintendo DS, which also contains WiFi support and free gameplay online. Nintendo will provide the servers for their own games, and presumably third party developers offering online support in their games will set up their own servers. This is in contrast to the model pioneered by Microsoft with the original Xbox, where a monthly fee is charged for access to the servers in exchange for matchmaking services, exclusive online content, and other features. It is not known if Nintendo will be offering any of these features with their online service.

I think that this is a smart move on Nintendo’s part. Not only are they creating great buzz for the Wii, but they are doing it at a price point that neither Xbox or Playstation can afford. After being disappointed with the 64, I always put Nintendo out of my mind, but between the unique controller and the low price points, I think that Nintendo could make up a lot of ground in the latest generation of the console wars. While it’s still too early to tell how cool the Wii really will be, the lack of online fees gets a hot donkey from me.

Netflix’s Ad Campaign Spawns New Competitor

You know that you’ve gone viral when people start making videos mocking your advertisment campaigns, some will try and fight it but the smart companies understand that it’s part of having internet rock star status. In a very funny clip, the guys at pwnediptv.com remake their own ‘Webflix’ commercial. Based on their business plan, I think Webflix could really clean house. After seeing this video, I’m going to have rethink putting Boys in the Hood in my queue.

Tom Roger’s The Man, The Myth, The Guy That Likes Slow Walks On The Beach?

PVR Wire has a great synopsis on an interview that TiVo’s CEO Tom Rogers did with the New York Times (Bugmenot) The article was published in an unusual style in that Amy Zipkin more or less transcribed Roger’s thoughts directly. In the article Roger’s talked about the start of his career and his experience leading up to being TiVo’s CEO.

Roger’s also goes on to discuss some of the challenges of balancing his family life with his career as well as some of the experience he picked up while working for General Electric. While the article doesn’t contain any juicy details about the series 3 or any new features it does offer a rare look into the softer side of what it takes to be a CEO.

Yo Quiero Taco Bell Bandido

Last week, Taco Bell didn’t exactly know what to do when they received 25,000 packets of hot sauce from a frequent customer, but this video from a few months ago is an even more impressive trick. The guys featured in the video figured out the radio frequency for Taco Bell’s drive through and hijacked their system to mess with customers, it’s very funny, but editor’s note, I’m pretty sure this is a major felony, kids don’t try this at home.

Note To Self: Don’t Piss Off Washington

I only lived in Seattle for three years, but it was long enough to get a sense of the pride that the Evergreen state takes in their sense of privacy. Washington was one of the first states to pass laws combatting spam and they’ve taken an aggressive stance against online marketing abuses that occur within in their state. In their latest move to combat spyware, Washington state has sued Movieland.com for alleging offering a “free three day trial” and then spamming users with pop ups saying that they owed them money.

I hope that Movieland gets buried by this lawsuit. If what is being alleged is true, they deserve to have an example made out of them. I understand that it’s tempting to use slime ball tactics to make money, but with so many opportunities out there, it’s really not necessary to try and scam people in order to make a living. Pop ups are bad enough, but to tell people that they owe money for a free trial is even worse.
